What Is a Property Deed?

A property deed is a legal document that transfers ownership of real estate from one person or entity to another. It identifies the buyer and seller, describes the property, and is recorded with the county to make the transfer official and public.

Types of Deeds Used in Alabama Real Estate Transactions

There are several types of deeds used in real estate transactions, including (but not limited to): 

General Warranty Deed

A general warranty deed provides the broadest protection for the buyer (grantee). It guarantees that the grantor (seller) holds clear title and will defend against any claims arising from prior ownership.

Special Warranty Deed

A special warranty deed guarantees that the seller has not caused any title issues during their ownership, but does not cover previous issues. It is commonly used in commercial transactions, foreclosures, and sales by financial institutions. 

Quitclaim Deed

A quitclaim deed transfers whatever interest the seller may have in the property. Unlike warranty deeds, quitclaim deeds do not contain title covenants. They are often used between family members or to clear up title issues.
